Troseddau gan gyrff corfforaethol
18.—(1) Pan brofir bod unrhyw drosedd o dan y Rheoliadau hyn neu unrhyw ddarpariaeth gywerth a gyflawnwyd gan gorff corfforaethol wedi'i chyflawni gyda chaniatâd neu oddefiad, neu i'w phriodoli i unrhyw esgeulustod ar ran cyfarwyddwr, rheolwr, ysgrifennydd neu swyddog cyffelyb i'r corff corfforaethol, neu berson sy'n honni gweithredu mewn unrhyw awdurdod o'r fath, bydd y person hwnnw yn ogystal â'r corff corfforaethol yn euog o'r drosedd ac yn agored i achos gael ei ddwyn yn ei erbyn ac i'w gosbi'n unol â hynny.
(2) Pan brofir bod unrhyw drosedd o dan y Rheoliadau hyn neu unrhyw ddarpariaeth gywerth a gyflawnwyd gan bartneriaeth wedi'i chyflawni gyda chaniatâd neu oddefiad, neu i'w phriodoli i esgeulustod ar ran partner, bydd y person hwnnw yn ogystal â'r bartneriaeth yn euog o'r drosedd ac yn agored i achos gael ei ddwyn yn ei erbyn ac i'w gosbi'n unol â hynny.
(3) Lle profir bod unrhyw drosedd o dan y Rheoliadau hyn neu unrhyw ddarpariaeth gywerth a gyflawnwyd gan gymdeithas anghorfforedig (ac eithrio partneriaeth), wedi'i chyflawni gyda chaniatâd neu oddefiad, neu i'w phriodoli i esgeulustod ar ran unrhyw swyddog i'r gymdeithas neu unrhyw aelod o'i gorff llywodraethu, bydd y person hwnnw yn ogystal â'r gymdeithas yn euog o'r drosedd ac yn agored i achos gael ei ddwyn yn ei erbyn ac i'w gosbi'n unol â hynny.
