Dynodi safleoedd arwerthu pysgod
6.—(1) Caiff unrhyw berson wneud cais i'r Cynulliad Cenedlaethol, gan ddefnyddio ffurflen o'r math a ragnodir gan y Cynulliad, i ddynodi man at ddibenion Erthygl 9 ac Erthygl 22 o'r Rheoliad CFP fel safle arwerthu pysgod.
(2) Rhaid i gais i ddynodi o dan y rheoliad hwn gynnwys datganiad ynglŷn â'r cyfleusterau a'r dulliau gweithredu arfaethedig a ddefnyddir ar y safle.
(3) Wrth ystyried cais i ddynodi o dan y rheoliad hwn, bydd y Cynulliad Cenedlaethol yn cymryd i gyfrif a yw'r datganiad ynglŷn â'r cyfleusterau a'r dulliau gweithredu arfaethedig ar y safle yn gyfryw ag y byddant o gymorth i gydymffurfio gydag Erthygl 9, Erthygl 22 y Rheoliad CFP a'r Rheoliadau hyn.
(4) Rhaid i'r Cynulliad Cenedlaethol hysbysu'r ymgeisydd yn ysgrifenedig o'i benderfyniad ynglŷn â chais i ddynodi a wnaed yn unol â'r rheoliad hwn.
(5) Pan fo'r Cynulliad Cenedlaethol yn cymeradwyo dynodiad bydd yn ddarostyngedig i Atodlen 2 a rhaid iddo bennu'r amodau a restrir ynddi.
(6) Rhaid i'r Cynulliad Cenedlaethol gyhoeddi rhestr o safleoedd arwerthu pysgod dynodedig yn ôl fel y gwêl yn dda.
(7) Gellir atal dynodiad safle arwerthu pysgod pan fo'r Cynulliad Cenedlaethol o'r farn–
(a)na chydymffurfiwyd ag amod yr oedd y dynodiad a ganiatawyd yn ddarostyngedig iddo; neu
(b)nad yw'r dulliau gweithredu a'r cyfleusterau ar y safle'n cydymffurfio â gofynion Erthygl 9, Erthygl 22 o'r Rheoliad CFP neu'r Rheoliadau hyn.
(8) Bydd unrhyw berson sy'n gwneud datganiad ffug yn ymwybodol neu'n fyrbwyll at ddibenion y rheoliad hwn yn euog o drosedd.
(9) Bydd unrhyw berson sy'n rheoli safle arwerthu pysgod dynodedig, neu ran o safle o'r fath, ac sy'n torri un o amodau dynodi'r safle, yn euog o drosedd.
(10) Yn y rheoliad hwn–
mewn cysylltiad â safle arwerthu pysgod dynodedig neu unrhyw ran o safle o'r fath, bydd “person sy'n rheoli safle arwerthu pysgod dynodedig” yn cynnwys, perchennog y safle neu'r rhan honno, neu asiant y perchennog, neu unrhyw berson sy'n rheoli mewn unrhyw fodd neu'n meddu ar y safle neu'r rhan honno.
