11.  Dileer paragraffau 2.39 a 2.40 ac yn eu lle rhodder —

2.39  Mae Gorchymyn Diwygio Rheoleiddio (Diogelwch Rhag Tân) 2005 (O.S. 2005/1541) ('GDT') yn ddiwygiad o bwys yng nghyfraith diogelwch rhag tân. Yr oedd y ddeddfwriaeth flaenorol o ran diogelwch rhag tân mewn dros gant o ddarnau o ddeddfwriaeth ar wahân. Daeth GDT i rym yng Nghymru a Lloegr ar 1 Hydref 2006. Trosglwyddwyd swyddogaethau a phwerau'r Ysgrifennydd Gwladol yn y GDT i Gynulliad Cenedlaethol Cymru ar 8 Mehefin 2006 drwy Orchymyn Cynulliad Cenedlaethol Cymru (Trosglwyddo Swyddogaethau) 2006 (O.S. 2006/1458).

2.40  Mae prif bwyslais y diwygio ar atal tanau mewn mangreoedd annomestig ac ar drefn o asesu risg rhag tân a fydd yn cael ei chyflawni gan y person cyfrifol er mwyn dynodi, lliniaru neu ddileu unrhyw risg rhag tân i bobl yn y mangreoedd neu o'u cwmpas. Diddymwyd tystysgrifau tân a bellach nid oes ganddynt unrhyw statws.

  • Mae cyngor ar gael i bobl sy'n gyfrifol am eu mangreoedd o ran asesu risg tân yng Nghanllawiau Asesu Risg Tanau Llywodraeth y Cynulliad.

  • Gorfodir y GDT yn bennaf gan yr Awdurdodau Tân ac Achub, er y gall awdurdodau eraill orfodi'r GDT mewn meysydd fel gofal iechyd neu fangreoedd niwclear.

  • Dylai polisi Awdurdod Tân ac Achub ar gyfer gorfodi'r GDT ffurfio rhan o'i strategaeth gyffredinol i ddiogelu ei gymuned, yn ôl y manylion yn ei CLlR.

  • Wrth iddo lunio ei bolisi gorfodi, dylai Awdurdod Tân ac Achub flaenoriaethu ei archwiliad o asesiadau risg tân ac arolygiadau o fangreoedd sy'n rhoi bywyd o dan risg arwyddocaol gan dân. Ceir canllawiau ar y mater hwn yng Nghylchlythyr Gwasanaeth Tân ac Achub Cymru (06) 06 — Gwybodaeth Atodol ar gyfer Awdurdodau Tân ac Achub ar ddatblygu eu Cynlluniau Lleihau Risg (CLlR). Dyroddwyd y canllawiau hyn o dan erthygl 26 o'r RRO ac o'r herwydd nid yw'n ffurfio rhan o'r Fframwaith hwn.
