The Welsh Ministers in exercise of the powers conferred on the National Assembly for Wales by sections 21(6), 60 and 62 of the Fire and Rescue Services Act 2004(1) and now vested in them(2) make the following Order:

Title, commencement and application

1.—(1) The title of this Order is the Fire and Rescue Services (National Framework) (Wales) Order 2008 and it comes into force on 22 September 2008.

(2) This Order applies in relation to Wales.

The National Framework

2.  The Fire and Rescue National Framework prepared by the Welsh Ministers and entitled “The Fire and Rescue National Framework for Wales 2008—2011” published by the Welsh Ministers on 28 August 2008 on the Welsh Assembly Government’s website(3) has effect as a revision, which appears to the Welsh Minsters to be significant, of the “The Fire and Rescue National Framework (Wales) 2005”(4).

Explanatory Note

(This note is not part of the Order)

Section 21 of the Fire and Rescue Services Act 2004 (“the Act”) requires the Welsh Ministers to prepare a Fire and Rescue National Framework (“Framework”), which must set out priorities and objectives for Fire and Rescue Authorities and may provide guidance. Fire and Rescue Authorities must have regard to the Framework in carrying out their functions.

Article 2 of this Order, which has effect in relation to Fire and Rescue Authorities in Wales, substitutes the Fire and Rescue National Framework for Wales 2008 — 2011 for the Fire and Rescue National Framework (Wales) 2005.

The Fire and Rescue National Framework for Wales 2008 — 2011 will have effect from 22 September 2008. The Fire and Rescue National Framework (Wales) 2005 was given effect by SI 2005/760 (W.64). Copies of the Fire and Rescue National Framework for Wales 2008 — 2011 may be obtained from Fire and Rescue Services Branch, Welsh Assembly Government, Rhyd y car, Merthyr Tydfil, CF48 1UZ. It was published on the Welsh Assembly Government website (http://new.wales.gov.uk/topics/housingandcommunity/safety/fire/?lang=en) on 28 August 2008.

A regulatory impact assessment has been prepared in connection with this Order. A copy can be obtained from the Fire and Rescue Services Branch, Welsh Assembly Government, Rhyd y car, Merthyr Tydfil, CF48 1UZ (tel: 01685 729253).

The functions of the National Assembly for Wales contained in the Fire and Rescue Services Act 2004 were vested in the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32).
