Mae Gweinidogion Cymru, ar ôl ymgynghori, yn unol ag adran 3(7) o Ddeddf Addysg (Ysgolion) 1997(1), â'r cyrff sy'n ymddangos iddynt yn rhai priodol a chynrychioliadol o ysgolion sydd o dan adran 2(1) o'r Ddeddf honno yn darparu lleoedd drwy gymorth, yn gwneud y Rheoliadau a ganlyn drwy arfer y pwerau a roddwyd iddynt gan adran 3(1), (2), (5) a (9) o'r Ddeddf honno(2):

Yr oedd swyddogaethau'r Ysgrifennydd Gwladol o dan adran 3 yn arferadwy gan Gynulliad Cenedlaethol Cymru o ran Cymru: gweler erthygl 2 o Orchymyn Cynulliad Cenedlaethol Cymru (Trosglwyddo Swyddogaethau) 1999 a'r cofnod mewn cysylltiad â Deddf Addysg (Ysgolion) 1997 yn Atodlen 1 iddo (O.S. 1999/672). Trosglwyddwyd y swyddogaethau wedi hynny i Weinidogion Cymru yn rhinwedd paragraff 30 o Atodlen 11 i Ddeddf Llywodraeth Cymru 2006 (p.32).
