The Violent Crime Reduction Act 2006 (Commencement No. 1) (Wales) Order 2010

The Welsh Ministers, in exercise of the powers conferred upon the National Assembly for Wales by section 66(2) and (3)(a) of the Violent Crime Reduction Act 2006(1), and now vested in them(2), make the following Order:

Title and interpretation

1.  The title of this Order is the Violent Crime Reduction Act 2006 (Commencement No. 1) (Wales) Order 2010.

Appointed Day

2.  Sections 45 and 46 of the Violent Crime Reduction Act 2006 come into force on 31 October 2010 in relation to Wales.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 31 October 2010 sections 45 and 46 of the Violent Crime Reduction Act 2006 in relation to Wales.

Section 45 of that Act inserts a new section 550AA into the Education Act 1996 relating to the power of members of staff to search pupils for weapons.

Section 46 of that Act inserts a new section 85B into the Further and Higher Education Act 1992 relating to the power to search further education students for weapons.

The powers conferred on the National Assembly for Wales in section 66 were transferred to the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
