The Welsh Ministers in exercise of the powers conferred upon them by sections 108(3)(c), (7), (8), (9), (10) and (11) and 210(7) of the Education Act 2002(1) make the following Order:
1.—(1) The title of this Order is the National Curriculum (Amendments to the Key Stage 2 and Key Stage 3 Assessment Arrangements) (Wales) Order 2011 and it comes into force on 1 September 2011.
(2) This Order applies to maintained schools in Wales.
2. The National Curriculum (Key Stage 2 Assessment Arrangements) (Wales) Order 2004(2) is amended as follows—
(a)in article 3(1), after the definition of “summer term” insert—
““working day” (“diwrnod gwaith”) means any day other than a Saturday, Sunday or a day which is a bank holiday within the meaning of section 1 of the Banking and Financial Dealings Act 1971(3).”; and
(b)in article 4(3) for “two weeks” substitute “twenty working days”.
3. The National Curriculum (Key Stage 3 Assessment Arrangements) (Wales) Order 2005(4) is amended as follows—
(a)in article 3(1), after the definition of “summer term” insert—
““working day” (“diwrnod gwaith”) means any day other than a Saturday, Sunday or a day which is a bank holiday within the meaning of section 1 of the Banking and Financial Dealings Act 1971.”; and
(b)in article 4(2) for “two weeks” substitute “twenty working days”.

The National Curriculum (Key Stage 2 Assessment Arrangements) (Wales) Order 2004 (“the 2004 Order”) specifies the assessment arrangements for the second key stage and the National Curriculum (Key Stage 3 Assessment Arrangements) (Wales) Order 2005 (“the 2005 Order”) specifies the assessment arrangements for the third key stage.
The 2004 Order and the 2005 Order place a duty on teachers to assess pupils in schools in Wales no later than two weeks before the end of the summer term. This Order amends that provision of the 2004 Order and the 2005 Order so that pupils must be assessed no later than twenty working days before the end of the summer term.
