Defnyddio cerbydau I gasglu sbwriel neu wymon oddi ar draethau
20.—(1) Mae erthygl 4 yn gymwys i weithgaredd symud gan ddefnyddio cerbyd, a ymgymerir gan neu ar ran awdurdod lleol at y diben o symud sbwriel neu wymon oddi ar draeth.
(2) Ond nid yw erthygl 4 yn gymwys i unrhyw weithgaredd symud o'r fath—
(a)sy'n dod o fewn is-baragraff (a) neu (b) o baragraff (3); a
(b)nad yw'n gysylltiedig yn uniongyrchol â, neu'n angenrheidiol ar gyfer rheoli'r safle y cyfeirir ato yn yr is-baragraff hwnnw.
(3) Mae gweithgaredd yn dod o fewn y paragraff hwn—
(a)os yw'n gynllun neu brosiect sy'n debygol (naill ai ar ei ben ei hun neu ar y cyd â chynlluniau neu brosiectau eraill) o gael effaith sylweddol ar safle Ewropeaidd; neu
(b)os yw'n debygol o gael effaith sylweddol ar safle Ramsar.
(4) Ym mharagraff (1), mae i “awdurdod lleol” yr ystyr a roddir i “local authority” yn adran 68(9) o'r Ddeddf.
(5) Ym mharagraff (3)(a) a (b), mae i “tebygol” yr ystyr a roddir i “likely” yng Nghyfarwyddeb y Cyngor 92/43/EEC ar gadwraeth cynefinoedd naturiol a ffawna a fflora gwyllt.
