Y pŵer i gaffael hawliau newydd
6.—(1) Caiff Network Rail gaffael drwy orfodaeth y cyfryw hawddfreintiau neu hawliau eraill dros unrhyw dir yr awdurdodwyd ef i'w caffael o dan erthygl 3 (y pŵer i gaffael tir) ag y bo eu hangen at unrhyw ddiben y caniateir caffael y tir hwnnw o dan y ddarpariaeth honno, drwy eu creu yn ogystal â thrwy gaffael hawddfreintiau neu hawliau eraill sydd eisoes yn bodoli.
(2) Yn ddarostyngedig i adran 8 o Ddeddf 1965 (fel y'i hamnewidir gan baragraff 5 o Atodlen 1 (addasu deddfiadau digolledu a phrynu gorfodol ar gyfer creu hawliau newydd)), pan fo Network Rail yn caffael hawl dros dir o dan baragraff (1), nid yw'n ofynnol iddo gaffael rhagor o fuddiant yn y tir hwnnw.
(3) Mae Atodlen 1 yn cael effaith at ddibenion addasu'r deddfiadau sy'n ymwneud â digolledu a darpariaethau Deddf 1965, o ran eu cymhwyso mewn perthynas â chaffael drwy orfodaeth hawl dros dir o dan yr erthygl hon drwy greu hawl newydd.
