Diwygio Rheoliadau Gwastraff Peryglus (Cymru) 2005

3.—(1) Mae Rheoliadau Gwastraff Peryglus (Cymru) 2005(1) wedi eu diwygio fel a ganlyn.

(2) Yn lle rheoliad 2(1)(a)(2) (y Gyfarwyddeb Wastraff ac ystyr gwastraff), rhodder—

“(a)ystyr “y Gyfarwyddeb Wastraff (“the Waste Directive”) yw Cyfarwyddeb 2008/98/EC Senedd Ewrop a’r Cyngor ar wastraff(3) fel y’i diwygiwyd ddiwethaf gan Reoliad y Comisiwn (EU) Rhif 1357/2014(4);” .

(3) Yn rheoliad 3(a)(5) (Atodiad III i’r Gyfarwyddeb Wastraff), hepgorer “, fel y gosodir yr Atodiad hwnnw yn Atodlen 3”.

(4) Yn lle rheoliad 4(1)(6) (y Rhestr Wastraffoedd), rhodder—

“(1) Yn y Rheoliadau hyn, ystyr “y Rhestr Wastraffoedd” (“the List of Wastes”) yw’r rhestr o wastraffoedd a sefydlir gan Benderfyniad y Comisiwn 2000/532/EC sy’n disodli Penderfyniad 94/3/EC sy’n sefydlu rhestr wastraffoedd yn unol ag Erthygl 1(a) o Gyfarwyddeb y Cyngor 75/442/EEC ar wastraff a Phenderfyniad y Cyngor 94/904/EC sy’n sefydlu rhestr o wastraffoedd peryglus yn unol ag Erthygl 1(4) o Gyfarwyddeb y Cyngor 91/689/EEC ar wastraff peryglus, fel y’i diwygir o bryd i’w gilydd.”.

(5) Yn rheoliad 6(b), yn lle “62A(1)” rhodder “62A(2)”.

(6) Yn rheoliad 8—

(a)ym mharagraff (1)(b), yn lle “62A(1)” rhodder “62A(2)”;

(b)ym mharagraff (2) (gwastraff penodol sydd i’w drin fel gwastraff peryglus), yn lle “Erthygl 3 o Benderfyniad y Rhestr Wastraffoedd” rhodder “Erthygl 7(2) o’r Gyfarwyddeb Wastraff”.

(7) Yn rheoliad 9—

(a)ym mharagraff (1)(b), yn lle “62A(1)” rhodder “62A(2)”;

(b)ym mharagraff (2), yn lle “Erthygl 3 o Benderfyniad y Rhestr Wastraffoedd” rhodder “Erthygl 7(3) o’r Gyfarwyddeb Wastraff”.

(8) Hepgorer Atodlen 3(7) (Atodiad III i’r Gyfarwyddeb Wastraff).

(9) Yn lle Atodlen 8 (ffurf ar ateb y traddodai i’r cynhyrchydd neu’r deiliad) rhodder y testun sydd yn yr Atodlen i’r Rheoliadau hyn.
