Rheoliadau Gwastraff Peryglus (Diwygiadau Amrywiol) (Cymru) 2015

Diwygio Rheoliadau Trwyddedu Amgylcheddol (Cymru a Lloegr) 2010

4.—( 1) Mae Rheoliadau Trwyddedu Amgylcheddol (Cymru a Lloegr) 2010(1) wedi eu diwygio fel a ganlyn.

(2) Yn rheoliad 2(1) (dehongli: cyffredinol) yn y diffiniad o “WEEE”, yn lle “Article 3(b)” rhodder “Article 3(1)(e)”.

(3) Yn adran 3 (dehongli: Cyfarwyddebau)—

(a) yn lle’r diffiniad o “the Waste Framework Directive” rhodder—

““the Waste Framework Directive” means Directive 2008/98/EC of the European Parliament and of the Council on Waste(2);”;

(b) yn lle’r diffiniad o “the WEEE Directive” rhodder—

““the WEEE Directive” means Directive 2012/19/EU of the European Parliament and of the Council on waste electrical and electronic equipment (WEEE)(3).”.

(4) Ym mharagraff 1 o bennod 1 o Ran 1 o Atodlen 3, (cyfleusterau esempt: disgrifiadau ac amodau)—

(a) yn is-baragraff (1), yn y man priodol, mewnosoder—

““List of Wastes” means the list of wastes established by Commission Decision 2000/532/EC replacing Decision 94/3/EC establishing a list of wastes pursuant to Article 1(a) of Council Directive 75/442/EEC on waste and Council Decision 94/904/EC establishing a list of hazardous waste pursuant to Article 1(4) of Council Directive 91/689/EEC on hazardous waste, as amended from time to time;”;

(b) yn lle is-baragraff (2) rhodder—

“(2) In this Part, a six digit code used to refer to a waste is a reference to the waste specified by the six digit code in the List of Wastes except insofar as the waste in this Part in relation to such a code does not include some of the types of waste specified by the code in the List”.

(5) Yn adran 2 o bennod 3 o ran 1 o Atodlen 3—

(a) ym mharagraff 1—

(i) yn is-baragraff (3)(e), yn lle “dangerous substance” rhodder “hazardous substance”;

(ii) yn lle is-baragraff (5), rhodder—

“(5) In this paragraph, “hazardous substance” means a substance classified as hazardous as a consequence of fulfilling the criteria laid down in parts 2 to 5 of Annex 1 to Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures(4).”;

(b) ym mharagraff 11 is-baragraff (3)(c) yn lle “Annex III” rhodder “Annex VIII”; ac

(c) yn y tabl ym mharagraff 15(2), yn ail golofn y rhes sy’n dechrau “160504*”, yn lle “dangerous substances”, rhodder “hazardous substances”.

(6) Yn adran 2 o bennod 5 o ran 1 o Atodlen 3, yn y tabl ym mharagraff 1(2), yn ail golofn y rhes sy’n dechrau “150202*”, yn lle “dangerous substances” rhodder “hazardous substances”.

(7) Yn Atodlen 12 (cyfarpar trydanol ac electronig gwastraff)—

(a) ym mharagraff 2, is-baragraff (1), yn lle “Article 3(b)” rhodder “Article 3(1)(e)”;

(b) ym mharagraff 3—

(i) yn is-baragraff (1), yn lle “Article 6(1) first paragraph and Article 6(3) and (4)” rhodder “Articles 8(1) to (3) and 9(3)”;

(ii) yn lle is-baragraff (2) rhodder—

“(2) But when interpreting the WEEE Directive for the purposes of this paragraph, ignore the following words in Article 9(3)—

(a) “or the registration referred to in paragraphs 1 and 2”; and

(b) “and for the achievement of the recovery targets set out in Article 11”.”.
