The Welsh Ministers make the following Order in exercise of the powers conferred on the Secretary of State by section 28 of the Further and Higher Education Act 1992(1) and now vested in them(2).

Title and commencement

1.  The title of this Order is The Merthyr Tydfil College Limited (Designated Institution in Further Education) Order 2015 and it comes into force on 31 July 2015.

Designation

2.  The Merthyr Tydfil College Limited (incorporated on 13 August 2008 as a company limited by guarantee and registered with company number 06671721), being an educational institution of the kind described in sub-sections (1) and (2)(d) of section 28 of the Further and Higher Education Act 1992, is designated as an institution for the purposes of that section.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates the Merthyr Tydfil College Limited, a college conducted by a registered company limited by guarantee, for the purposes of section 28 of the Further and Higher Education Act 1992.

The designation of the Merthyr Tydfil College Limited means that it is to be treated as an institution within the further education sector for the purposes of the Education Acts (within the meaning given by sections 91(1) and 91(3) of the Further and Higher Education Act 1992 and section 578 of the Education Act 1996).

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.

1992 c.13. Section 28 was amended by the School Standards and Framework Act 1998 (c. 31), Schedule 30 and the Learning and Skills Act 2000 (c. 21), section 143 and Schedule 11. There are other amendments to section 28 that are not relevant to this Order.

The functions of the Secretary of State under section 28 of the Further and Higher Education Act 1992 were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1996/672). The functions of the National Assembly for Wales were transferred to the Welsh Ministers by virtue of section 162 of and paragraph 30(1) and 30(2)(a) of Schedule 11 to the Government of Wales Act 2006 (c. 32).
