The Welsh Ministers, in exercise of the powers conferred on the Secretary of State by sections 20 and 190 of the Local Government and Housing Act 1989(1), now exercisable by them(2) make the following Regulations.

1989 c. 42. Section 20 was amended by section 119 and paragraph 81(1) and (4) of Schedule 6 to the Local Democracy, Economic Development and Construction Act 2009 (c. 20), by section 23 (1) and paragraph 12(1) and (4) of Schedule 5 to the Cities and Local Government Devolution Act 2016 (c. 1); and by section 39(5)(b) of the Planning (Wales) Act 2015 (anaw 4).

Powers under sections, 20 and 190 of the Local Government and Housing Act 1989 are now vested in the Welsh Ministers so far as they are exercisable in relation to Wales. They were previously vested in the National Assembly for Wales by virtue of article 2 and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672). By virtue of paragraphs 30 and 32 of Schedule 11 to the Government of Wales Act 2006 (c. 32), they were transferred to the Welsh Ministers.
