The Welsh Ministers, in exercise of the powers conferred by section 16 of the Plant Varieties and Seeds Act 1964(1), make the following Regulations.
In accordance with section 16(1) of that Act, the Welsh Ministers have consulted with representatives of such interests as appear to the Welsh Ministers to be concerned.
1.—(1) The title of these Regulations is the Seed Potatoes (Wales) (Amendment) Regulations 2017.
(2) These Regulations apply in relation to Wales and come into force on 18 May 2017.
2.—(1) The Seed Potatoes (Wales) Regulations 2016(2) are amended as follows.
(2) In Regulation 3 (interpretation: European instruments) for the definition of “the Directive” substitute—
““the Directive” (“ y Gyfarwyddeb ”) means Council Directive 2002/56/EC on the marketing of seed potatoes(3);”.
(3) In Part 1 of Schedule 2 (official labels and official documents), after paragraph 7(b)(i), insert—
“(ia)an officially assigned serial number;”.

These Regulations amend the Seed Potatoes (Wales) Regulations 2016 (S.I. 2016/106 (W.52)).
These Regulations implement Commission Implementing Directive (EU) 2016/317 (OJ L 60, 5.3.2016, p. 72–75), amending Council Directive 2002/56/EC (OJ L 193, 20.7.2002, p. 60–73), by amending the requirements for the official label on basic and certified seed potatoes in the 2016 Regulations.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.
1964 (c.14); Section 16(1) was amended and section 16(1A) was inserted by the European Communities Act 1972 (c. 68), Schedule 4, paragraph 5. The functions of the Minister, so far as exercisable in relation to Wales, transferred to the Secretary of State by article 2 of, and Schedule 1 to, the Transfer of Functions (Wales)(No.1) Order 1978 (S.I. 1978/272). Those functions were then transferred to the National Assembly for Wales by article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672). The functions of the National Assembly for Wales now vest in the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c.32).
