EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Seed Potatoes (Wales) Regulations 2016 (S.I. 2016/106 (W.52)).

These Regulations implement Commission Implementing Directive (EU) 2016/317 (OJ L 60, 5.3.2016, p. 72–75), amending Council Directive 2002/56/EC (OJ L 193, 20.7.2002, p. 60–73), by amending the requirements for the official label on basic and certified seed potatoes in the 2016 Regulations.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.

(1)

1964 (c.14); Section 16(1) was amended and section 16(1A) was inserted by the European Communities Act 1972 (c. 68), Schedule 4, paragraph 5. Those functions were then transferred to the National Assembly for Wales by article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672). The functions of the National Assembly for Wales now vest in the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c.32).
