Changes to Legislation

16.—(1) Pan na fo’r fangre a bennir mewn cais mewn ardal reoledig, ni chaiff y Bwrdd Iechyd Lleol ganiatáu’r cais ond os yw wedi ei fodloni y byddai’n diwallu angen am wasanaethau fferyllol, neu am wasanaethau fferyllol o fath penodedig, yn ardal y Bwrdd Iechyd Lleol perthnasol ac sydd wedi eu cynnwys yn asesiad y Bwrdd Iechyd Lleol hwnnw o anghenion fferyllol yn unol ag Atodlen 1.
(2) Pan fo’r fangre a bennir mewn cais mewn ardal reoledig ond nid mewn lleoliad neilltuedig (fel y’i diffinnir yn rheoliad 17(4) a (5)), caiff y Bwrdd Iechyd Lleol—
(a)gwrthod y cais pan fo o’r farn y byddai ei ganiatáu yn niweidio darpariaeth briodol gwasanaethau meddygol sylfaenol, gwasanaethau gweinyddu neu wasanaethau fferyllol yn yr ardal reoledig y mae’r fangre a bennir yn y cais ynddi (y “prawf niweidio”), a
(b)pan na fo’r cais wedi ei wrthod o dan y prawf niweidio, ganiatáu’r cais ond dim ond os yw wedi ei fodloni ei fod yn diwallu angen a nodir yn asesiad y Bwrdd Iechyd Lleol perthnasol o anghenion fferyllol.
(3) Nid yw’r prawf niweidio yn gymwys os yw Bwrdd Iechyd Lleol yn penderfynu cais pan fo’r fangre a bennir yn y cais mewn lleoliad neilltuedig.
(4) Rhaid i Fwrdd Iechyd Lleol wrthod cais nad yw’r ceisydd yn diwallu angen ynddo sydd wedi ei nodi yn asesiad y Bwrdd Iechyd Lleol perthnasol o anghenion fferyllol.
(5) Wrth benderfynu cais o dan y rheoliad hwn, sydd wedi ei wneud yn unol â rheoliad 15(1), (ac eithrio pan fo’r cais wedi ei wneud gan berson y rhoddwyd cydsyniad rhagarweiniol iddo yn unol â rheoliad 18 a bod y cydsyniad rhagarweiniol hwnnw yn ddilys yn unol â rheoliad 18(5)), neu yn unol â rheoliad 18 pan na fo’r ceisydd eisoes wedi ei gynnwys yn rhestr fferyllol y Bwrdd Iechyd Lleol hwnnw, caiff Bwrdd Iechyd Lleol—
(a)gohirio ystyried y cais ar sail addasrwydd yn unol â rheoliad 36 (gohirio ceisiadau ar sail addasrwydd),
(b)gwrthod y cais ar sail addasrwydd yn unol â rheoliad 37 (gwrthod ceisiadau ar sail addasrwydd), neu
(c)gosod amodau ar ganiatáu’r cais yn unol â rheoliad 38 (cynnwys person yn amodol ar sail addasrwydd).
