RHAN 8 Darpariaethau cyffredinol mewn perthynas â staff

Gwarant a gymerir mewn perthynas â staff

33.   Ar ôl adran 114(3) o Ddeddf 1972 (gwarant i’w chymryd mewn perthynas â swyddogion) mewnosoder—

“(4) In this section “local authority” includes a corporate joint committee.”

Atebolrwydd staff

34.   Ar ôl adran 115(2) o Ddeddf 1972 (atebolrwydd swyddogion) mewnosoder—

“(3) In this section “local authority” includes a corporate joint committee.”

Dyletswydd ar staff i ddatgelu buddiant mewn contractau

35.   Yn adran 117 o Ddeddf 1972 (datgelu buddiannau mewn contractau gan swyddogion)—

(a) yn is-adran (4), ar ôl “include references” mewnosoder “to a corporate joint committee and”;

(b) ar ôl yr is-adran honno mewnosoder—

“(5) In the application of this section to a corporate joint committee—

(a) the reference in subsection (1) to any committee of an authority is to be read as a reference to any sub-committee of the corporate joint committee, and

(b) section 95 of this Act is to be treated as if it applies to a corporate joint committee as it applies to another authority for the purposes of this section.”

36.   Yn adran 7 o Ddeddf 1989 (yr holl staff i’w penodi ar sail teilyngdod)—

(a) yn is-adran (1)—

(i) hepgorer “or” ar ôl paragraff (aa);

(ii) ar ôl y paragraff hwnnw mewnosoder—

“(ab) a corporate joint committee, or”;

(b) yn is-adran (2)—

(i) ar ôl “committee” mewnosoder “or sub-committee”;

(ii) ar ôl “local authority” mewnosoder “, corporate joint committee”.

Terfyn ar wyliau â thâl ar gyfer dyletswyddau llywodraeth leol

37.   Yn adran 10(2) o Ddeddf 1989 (terfyn ar wyliau â thâl ar gyfer dyletswyddau awdurdod lleol)—

(a) hepgorer “and” yn union ar ôl y diffiniad o “financial year”;

(b) ar ôl y diffiniad hwnnw mewnosoder—

““local authority” includes a corporate joint committee; and”.

Gwrthdaro buddiannau mewn negodiadau staff

38.   Yn adran 12(2) o Ddeddf 1989 (gwrthdaro buddiannau mewn negodiadau staff), o flaen y diffiniad o “member” mewnosoder—

““local authority” includes a corporate joint committee;”.

Aelodau wedi eu hanghymhwyso rhag bod yn aelodau o staff

39.   Mae aelod o gyd-bwyllgor corfforedig wedi ei anghymhwyso rhag cael ei benodi neu ei ethol gan y cyd-bwyllgor corfforedig hwnnw i unrhyw swydd daledig ac eithrio swydd cadeirydd neu is-gadeirydd.
