Y Gorchymyn hwn yw’r unig orchymyn cychwyn a wnaed gan Weinidogion Cymru o dan Ddeddf Rhentu Cartrefi (Diwygio) (Cymru) 2021 (dsc 3) (“y Ddeddf”) ac mae’n dwyn i rym baragraff 28 o Atodlen 6 i’r Ddeddf.
Mae’r Ddeddf yn gwneud darpariaeth ynghylch sicrwydd meddiannaeth o dan Ddeddf Rhentu Cartrefi (Cymru) 2016 (dccc 1), darpariaethau amrywiol yn ymwneud â chontractau meddiannaeth a darpariaethau cysylltiedig eraill.
Daeth adrannau 15, 17, 19 ac 20 o’r Ddeddf i rym ar 8 Ebrill 2021 (drannoeth y diwrnod y cafodd y Ddeddf y Cydsyniad Brenhinol) yn unol ag adran 19(1) o’r Ddeddf. Daeth gweddill darpariaethau’r Ddeddf, ac eithrio paragraff 28 o Atodlen 6, i rym ar 7 Mehefin 2021 (ddau fis ar ôl y diwrnod y cafodd y Ddeddf y Cydsyniad Brenhinol) yn unol ag adran 19(2) a (3) o’r Ddeddf.
Mae erthygl 2 o’r Gorchymyn hwn yn cychwyn paragraff 28 o Atodlen 6 i’r Ddeddf ar 1 Rhagfyr 2022.
Mae paragraff 28 o Atodlen 6 i’r Ddeddf yn diwygio Deddf Rhentu Cartrefi (Ffioedd etc.) (Cymru) 2019 (dccc 2) (“Deddf 2019”) er mwyn—
(a)hepgor paragraff (b) o adran 6 (cymhwyso adrannau 2 i 5 o Ddeddf 2019 i ofynion a chontractau sydd eisoes yn bodoli), a
(b)hepgor adran 25 (pŵer i wneud darpariaeth drosiannol mewn cysylltiad â thenantiaethau sicr).
