The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities previously managed by the former East Riding Health Authority resulting from the establishment of the East Yorkshire Community Healthcare National Health Service Trust(2), having consulted the East Riding Health Authority(3) and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the East Yorkshire Community Healthcare National Health Service Trust (Transfer of Trust Property) Order 1996 and shall come into force on 16th December 1996.

(2) In this Order—

“the Authority” means the East Riding Health Authority established on 1st April 1996(4);

“the old Authority” means the East Riding Health Authority established on 1st April 1993(5) and abolished on 1st April 1996(6);

“the Trust” means the East Yorkshire Community Healthcare National Health Service Trust;

“the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the old Authority and the Trust on 20th December 1995, which schedule has been signed on behalf of both the old Authority and the Trust.

Transfer of trust property

2.  On 16th December 1996 the trust property shall be transferred from the Authority to the Trust.

Explanatory Note

(This note is not part of the Order)

This Order transfers to the East Yorkshire Community Healthcare National Health Service Trust on 16th December 1996 trust property held by the East Riding Health Authority. A copy of the schedule of trust property to which the Order refers can be obtained from the Department of Health, NHS Trust Unit, Room 1W29, Quarry House, Quarry Hill, Leeds LS2 7UE.
