3. Section 62 (special provision with respect to certain dangerous and intractable waste) of the 1990 Act M1 shall have effect, without modification, so as to empower the Secretary of State to make provision for waste which would be controlled waste but for the fact that it is radioactive waste within the meaning of the [F2Environmental Authorisations (Scotland) Regulations 2018 ]; [F3and paragraphs (1) and (2) of regulation 2] [F3regulations 2 to 2B] shall apply to any such waste as if it were controlled waste.]
