The Scottish Ministers make the following Order in exercise of the powers conferred by sections 44(3) and 96(2) of the Climate Change (Scotland) Act 2009(1), and sections 151(3) and 207(4)(a) of the Equality Act 2010(2) and all other powers enabling them to do so.
In accordance with section 44(7) of the Climate Change (Scotland) Act 2009 the Scottish Ministers have consulted such associations of local authorities and such other persons as they considered appropriate.
In accordance with section 152(3) of the Equality Act 2010(3) the Scottish Ministers have consulted the Commission for Equality and Human Rights.
In accordance with section 96(4) of the Climate Change (Scotland) Act 2009(4) and section 210(2) of the Equality Act 2010 a draft of this Order has been laid before, and approved by resolution of, the Scottish Parliament.
1. This Order may be cited as the Scottish National Investment Bank p.l.c. (Miscellaneous Listings) Order 2020 and comes into force on 26 November 2020.
2.—(1) The Equality Act 2010 is amended in accordance with paragraph (2).
(2) In Part 3 of schedule 19 (public authorities: relevant Scottish authorities)(5), at the end insert—
“Other body added on 26th November 2020
The Scottish National Investment Bank p.l.c.”.
3.—(1) The Climate Change (Duties of Public Bodies: Reporting Requirements) (Scotland) Order 2015(6) is amended in accordance with paragraph (2).
(2) In schedule 1 (listed bodies), at the end insert—
“The Scottish National Investment Bank p.l.c.”.

This Order makes amendments to the Equality Act 2010 (“the 2010 Act”) and the Climate Change (Duties of Public Bodies: Reporting Requirements) (Scotland) Order 2015 (“the 2015 Order”).
Article 2 adds the Scottish National Investment Bank p.l.c to Part 3 of schedule 19 of the 2010 Act, which lists Scottish public authorities required to comply with the public sector equality duty.
Article 3 adds the Scottish National Investment Bank p.l.c. to schedule 1 of the 2015 Order, which lists bodies which are subject to the reporting requirements in that Order.
2009 asp 12. In section 44(3) “relevant public bodies” has the meaning given by section 44(5) of that Act (“the Act”). It refers to a Scottish public body (within the meaning of section 3(1)(a) of the Freedom of Information (Scotland) Act 2002 (asp 13) which has climate change duties under section 44(1) or by virtue of section 44(3) of the Act.
Section 152(3) was amended by section 37(7) of the Scotland Act 2016 (c.11).
Section 96(4) has been modified by paragraph 5 of schedule 3 of the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10).
Part 3 of schedule 19 has been relevantly amended by S.S.I. 2018/214.
