The Minister of Agriculture, Fisheries and Food, in the case of land in England, and the Secretary of State, in the case of land in Wales, in exercise of the powers conferred on them by paragraph 6 of Schedule 1 to the Agriculture Act 1986(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Title and commencement

1.  This Order may be cited as the Milk Quota (Calculation of Standard Quota) (Amendment) Order 1992 and shall come into force on 19th June 1992.

Amendment of principal Order

2.—(1) The Milk Quota (Calculation of Standard Quota) Order 1986(2) is hereby amended in accordance with the following provisions of this article.

(2) For article 2 there shall be substituted the following article:

2.  In this Order, the expressions “disadvantaged land” and “severely disadvantaged land” have the same meaning as in the Hill Livestock (Compensatory Allowances) Regulations 1992(3)..

(3) For the Schedule there shall be substituted the provisions contained in the Schedule to this Order.

In witness whereof the Official Seal of the Minister of Agriculture, Fisheries and Food is hereunto affixed on 22nd May 1992.

Explanatory Note

(This note is not part of the Order)

This Order further amends the Milk Quota (Calculation of Standard Quota) Order 1986 (“the 1986 Order”) by substituting for the Schedule to that Order a new Schedule, in which the figures for quota per hectare prescribed by article 3 of that Order are revised (article 2). (The figures for the yield per hectare, prescribed by article 4 of the 1986 Order, remain unchanged.) This Order also amends article 2 of the 1986 Order to take account of the making of the Hill Livestock (Compensatory Allowances) Regulations 1992. Quota per hectare is prescribed for the purposes of calculating the payment which a tenant in England and Wales is entitled, in certain circumstances, to obtain from his landlord in respect of milk quota on the termination of the tenancy of the land, under Schedule 1 to the Agriculture Act 1986.
