This Order applies the provisions of Part I of the Transport and Works Act 1992 (which provides for the making of orders authorising the construction and operation of certain systems of transport and related matters) to the modes of guided transport prescribed in Article 2 and defined by Article 3 of this Order. The application of the Order is limited to modes whose sole or primary purpose is the carriage of passengers.
The modes so prescribed are those which take the form of an aerial cableway or a monorail; or which employ magnetic force for support and guidance; or which are capable of operating on roads but which derive guidance from a buried cable (electronically, magnetically or by other means), a single rail or slot, or side-mounted apparatus; or which operate on a segregated track and derive guidance from sidemounted apparatus. Also prescribed are lifts, but only those serving street areas and which are not inclined at an angle of 15° or more from the vertical. Lifts beyond this degree of inclination are funicular railways for the purposes of the Act.
