The Social Fund Cold Weather Payments (General) Amendment Regulations 1993

The Secretary of State for Social Security, in exercise of the powers conferred on him by sections 138(2) and (4) and 175(1), (3) and (4) of the Social Security Contributions and Benefits Act 1992(1) and of all other powers enabling him in that behalf, after agreement by the Social Security Advisory Committee(2) that proposals in respect of these Regulations should not be referred to it, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Social Fund Cold Weather Payments (General) Amendment Regulations 1993 and shall come into force on 1st November 1993.

(2)  In these Regulations “the principal Regulations” means the Social Fund Cold Weather Payments (General) Regulations 1988(3).

Amendment of regulation 1A of the principal Regulations

2.  In paragraph (i) of regulation 1A of the principal Regulations (prescribed description of persons to whom payments for meeting expenses for heating in cold weather may be made)(4), after the word “Regulations” there shall be added the words “, but does not include the allowance specified in paragraph 2A of that Schedule (residential allowances)(5)”.

Amendment of Schedule 1 to the principal Regulations

3.  In Schedule 1 to the principal Regulations (Post Office postcode areas assigned to designated National Climatological Message Stations)

(a)entries 10 (Brawdy), 16 (Coningsby), 18 (Cwmbargoed) and 44 (Prestwick) shall be omitted;

(b)for entries 2, 8, 14, 22, 23, 27, 31, 34, 38, 45, 55, 58 and 61, there shall be respectively substituted the entries in Schedule 1 to these Regulations;

(c)new entry 52A (Tulloch Bridge), specified in Schedule 1 to these Regulations, shall be inserted after entry 52 (Trawsfyndd).

Amendment of Schedule 2 to the principal Regulations

4.  In Schedule 2 to the principal Regulations (Post Office post code areas and sectors) in Table 1, the entry relating to “Cardiff & Glamorgan” in Schedule 2 to these Regulations shall be inserted after the entry for “New Forest & Isle of Wight” and the entry relating to “Birmingham & Nottingham” shall be substituted in the Table for the existing entry relating to “Birmingham & Nottingham”(6).

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend regulation 1A of the Social Fund Cold Weather Payments (General) Regulations 1988 so that persons whose applicable amount for the purposes of income support includes a residential allowance, shall not be entitled to a cold weather payment out of the Social Fund. They amend Schedule 1 to those Regulations making changes to the areas linked to national climatological message stations by way of Post Office postcodes and also make additions to Table 1 in Schedule 2 to those Regulations which identifies postcode areas by reference to maps produced by Datamaps Ltd.

A person may establish the current postcode for his address by contacting any post office.

These Regulations do not impose a charge on businesses.
