PLANT HEALTH

The Plant Health (Licence Fees) (England and Wales) Regulations 1996

The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, acting jointly, in exercise of the powers conferred on them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Title, commencement, extent and interpretation

1.—(1) These Regulations may be cited as the Plant Health (Licence Fees) (England and Wales) Regulations 1996 and shall come into force on 1st February 1996.

(2) These Regulations extend to England and Wales.

(3) In these Regulations—

“growing medium” and “soil” have the meanings ascribed to them by the Plant Health (Great Britain) Order 1993(3); and

“licence” means a licence under article 30 or 30A of that Order.

Revocation

2.  The Import (Plant Health Fees) (England and Wales) Order 1993(4) is hereby revoked.

Fees

3.  There shall be paid to the Minister of Agriculture, Fisheries and Food in respect of each application or inspection of a type described in column 2 of the Schedule to these Regulations the fee prescribed in column 3 of the Schedule in relation to that type of application or inspection.

SCHEDULEFEES IN RESPECT OF APPLICATIONS FOR LICENCES AND INSPECTIONS IN CONNECTION WITH LICENCES

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which come into force on 1st February 1996, supersede the Import (Plant Health Fees) (England and Wales) Order 1993, which is revoked by the Regulations.

The Regulations prescribe the fees applicable in England and Wales for licences under the Plant Health (Great Britain) Order 1993, including fees for the new licences for trial or scientific purposes or for work on varietal selections introduced by the Plant Health (Great Britain) (Amendment) Order 1996. The structure of the fees that were previously prescribed by the Import (Plant Health Fees) (England and Wales) Order 1993 has been completely revised.

The effect of the fee restructuring is explained in a Compliance Cost Assessment, which has been placed in the libraries of both Houses of Parliament. Copies of the Compliance Cost Assessment can be obtained from the Plant Health Division of the Ministry of Agriculture, Fisheries and Food, Foss House, Kings Pool, 1–2 Peasholme Green, York YO1 2PX.
