The Secretary of State for Transport, in exercise of the powers conferred by sections 22(1)(c) and (d), (1B), (2) and (2A), 57(1) and 59(2)(a) of, and paragraph 24 of Schedule 2 to, the Vehicle Excise and Registration Act 1994(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) Regulations 2003 and shall come into force on 1st October 2003.

Preliminary

2.  The Road Vehicles (Registration and Licensing) Regulations 2002(2) shall be amended as follows.

Change of keeper

3.—(1) In regulation 21(3) for “he shall notify” there shall be substituted “he shall forthwith notify”.

(2) In regulation 22(2)(b) for “the remainder of the registration document to the Secretary of State, duly completed to include the following” there shall be substituted “to the Secretary of State on the remainder of the registration document, or otherwise in writing, the following information”.

(3) In regulation 24(5)(a)(iii) for “registered keeper” there shall be substituted “vehicle trader”.

Disclosure of registration and licensing particulars

4.  In regulation 27(1)(d) “in Northern Ireland” shall be omitted.

Nil licences

5.  In regulation 33(1) after “otherwise” there shall be inserted “than”.

Regulations prescribed under section 59(2) of the Vehicle Excise and Registration Act 1994

6.  In regulation 47 for “(fines not to exceed level 3 on the standard scale applies)” there shall be substituted “(fines not to exceed level 3 on the standard scale) applies”.

Exempt vehicles: vehicles imported by members of foreign armed forces and others

7.  In Schedule 5 for paragraph 3 and 4 there shall be substituted paragraphs 3 and 4 as set out in the Schedule to these Regulations.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Road Vehicles (Registration and Licensing) Regulations 2002 (“the Principal Regulations”).

Regulation 3 amends provisions of the Principal Regulations about changes in the keeper of a vehicle. Regulation 4 amends regulation 27 of the Principal Regulations so that the exemption from the payment of a fee for the disclosure of information is extended to all Customs and Excise officers. Regulations 5 and 6 make small drafting amendments to regulations 33 and 47.

Regulation 7 amends Schedule 5 to the Principal Regulations, which exempts vehicles imported by members of specified foreign armed forces and international headquarters and organisations from vehicle excise duty, by substituting new lists of countries and other bodies concerned.
