The Secretary of State makes the following Order in exercise of the powers conferred by section 94(1) and (2) of the Environmental Protection Act 1990(1):
1.—(1) This Order may be cited as the Street Litter Control Notices (England)(Amendment) Order 2007 and comes into force on 1st July 2007.
(2) This Order applies in England.
2. In article 2 (prescribed commercial and retail premises) of the Street Litter Control Notices Order 1991(2), for paragraph (b) substitute—
“(b) premises used wholly or partly for the sale of food or drink for consumption on the premises,”.

This Order, which applies in England, amends the Street Litter Control Notices Order 1991 (S.I. 1991/1324). Article 2 of that Order prescribes the descriptions of commercial or retail premises in respect of which a street litter control notice may be issued. Paragraph (b) of that article is replaced such that premises used wholly or partly for the sale of food or drink for consumption on the premises are prescribed.
A Regulatory Impact Assessment of the effect that this instrument will have on the costs of business and the voluntary sector has been prepared and is available from Local Environment Protection, Department for Environment, Food and Rural Affairs, Zone 7/D9, Ashdown House, 123 Victoria Street, London SW1E 6DE and at www.defra.gov.uk.
S.I. 1991/1324, to which there is an amendment not relevant to this Order.
