The Secretary of State makes these Regulations in exercise of the powers conferred by Articles 5(3), 38(3), 57(2) and 72(3) of Regulation (EU) 2018/858 of the European Parliament and of the Council of 30 May 2018 on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles (“Regulation (EU) 2018/858”)(1) and by Article 14(1)(a) of Regulation (EC) No 661/2009 of the European Parliament and of the Council of 13 July 2009 concerning type-approval requirements for the general safety of motor vehicles, their trailers and systems, components and separate technical units intended therefor (“Regulation (EC) No 661/2009”)(2).

The Secretary of State has consulted with representative organisations in accordance with Article 82(3) of Regulation (EU) 2018/858 and Article 15(3) of Regulation (EC) No 661/2009.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Road Vehicles (Type-Approval) (Amendment) Regulations 2024.

(2) Subject to paragraph (3), these Regulations come into force on 7th March 2024.

(3) In regulation 2(3)(b), the entries in the substituted table for “Emissions light duty vehicles (real driving emissions)” in item 2A come into force on 26th March 2024, except for the subject entry including note (3) (which accordingly comes into force on 7th March 2024).

(4) These Regulations extend to England and Wales, Scotland and Northern Ireland.

Amendment of Regulation (EU) 2018/858

2.—(1) Regulation (EU) 2018/858 of the European Parliament and of the Council of 30 May 2018 on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles is amended as follows.

(2) In Annex II, Part I, for item “41A”, substitute—

For vehicles with a reference mass exceeding 2 610 kg which are not type-approved (at the manufacturer’s request and provided the reference mass does not exceed 2 840 kg) under Regulation (EC) No 715/2007.

For vehicles with a technically permissible maximum laden mass exceeding 7 500 kg..

(3) In Annex II, Part II―

(a)for the first paragraph below the title, substitute—

Where reference is made to a separate Directive or Regulation in the table in Part I—

(a)a type-approval granted under the following UN Regulations, or

(b)a Universal International Whole Vehicle Type Approval issued under UN Regulation No 0(6) that includes type-approval of the relevant item under the following UN Regulations,

shall be considered as equivalent to a GB type-approval granted under the relevant separate Directive or Regulation, being UN Regulations to which the United Kingdom has accepted as a contracting party to the Revised 1958 Agreement..

(b)for the table, substitute—

For pure electric vehicles and hydrogen fuel cell vehicles, evidence of compliance with paragraph 3.1.1(b) of UN Regulation No 83.08 (anti-tampering measures applied in relation to the odometer) is considered equivalent to holding a type-approval under this Regulation.

(3)

Evidence of compliance with Annex IIIA of Regulation (EU) 2017/1151 of 1 June 2017 supplementing Regulation (EC) No 715/2007 of the European Parliament and of the Council on type-approval of motor vehicles with respect to emissions from light passenger and commercial vehicles (Euro 5 and Euro 6) and on access to vehicle repair and maintenance information(26) is also acceptable for this subject.

In addition to UN Regulation No 133, paragraph 4(3) of Schedule A1 to the Road Vehicles (Approval) Regulations 2020(27) applies.

(5)

The component type-approval provided for in UN Regulation No 134 of hydrogen storage systems, automatic shut-off valves, check or non-return valves and thermally-activated pressure relieve devices is mandatory. In addition, the obligatory material qualification of all components that are covered by Article 2(2) of Regulation (EC) No 79/2009 of the European Parliament and of the Council of 14 January 2009 on type-approval of hydrogen-powered motor vehicles(28) applies..

Amendment of Commission Implementing Regulation (EU) 2020/683

3.  In Commission Implementing Regulation (EU) 2020/683 of 15 April 2020 implementing Regulation (EU) 2018/858 of the European Parliament and of the Council with regards to the administrative requirements for the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles(29), in Annex V, in point 4(b), for the sentence beginning “Instead of the upper-case letter ‘E’…”, substitute “Instead of the upper-case letter ‘E’, the lower-case letter ‘g’ shall be used, followed by the number 11.”.

Amendment of Commission Regulation (EU)1003/2010

4.—(1) Commission Regulation (EU) No 1003/2010 of 8 November 2010 concerning type-approval requirements for the space for mounting and the fixing of rear registration plates on motor vehicles and their trailers(30) is amended as follows.

(2) In Article 2 (Provisions for GB type-approval of a motor vehicle or a trailer with regard to the space for mounting and the fixing of rear registration plates) for paragraph 3, substitute—

3.  If the relevant requirements set out in either—

(a)Annex II to this Regulation, or

(b)subject to paragraph 3A, Part 2 of Annex III to Commission Implementing Regulation (EU) 2021/535(31) as it applies in EU law on the date that the Road Vehicles (Type-Approval) (Amendment) Regulations 2024 are made,

are met, the approval authority shall grant a GB type-approval and issue a type-approval number in accordance with the numbering system set out in Annex IV to Commission Implementing Regulation (EU) 2020/683.

The approval authority may not assign the same number to another vehicle type.

3A.  Where type-approval is sought pursuant to paragraph 3(b) above, the relevant requirements—

(a)do not include the requirements within that Part—

(i)at points 2.1.2. and 2.4.5.; or

(ii)any which relate to front registration plates; and

(b)include the requirement at point 1.2.3. of Annex II to this Regulation..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend Regulation (EU) 2018/858, Commission Implementing Regulation (EU) 2020/683 and Commission Regulation (EU)1003/2010.

Regulation 2 updates the table of regulatory acts for GB type-approvals and the table of UN Regulations recognised as equivalent to GB type-approval requirements, to take account of regulatory developments and to reinstate entries omitted in error by the European Commission in Regulation (EU) 2018/858. Regulation 2(4) updates the table of regulatory acts for which a manufacturer may be designated as a technical service, to reinstate an entry omitted in error by the European Commission in Regulation (EU) 2018/858.

Regulation 3 corrects a typographical error in Commission Implementing Regulation (EU) 2020/683.

Regulation 4 amends Commission Regulation (EU)1003/2010 on the type-approval and mounting of rear registration plate spaces to ensure that compliance with updated EU technical requirements can be accepted as alternative to the GB requirements, for the purposes of GB type-approval.
