The National Health Service (Dental Charges) Amendment (Wales) Regulations 2000

The National Assembly for Wales makes the following Regulations in exercise of the powers conferred on it by section 79A of, and paragraph 3(2) and 3(3) of Schedule 12 to, the National Health Service Act 1977(1) and all other powers enabling it in that behalf:–

Citation, commencement and application

1.—(1) These Regulations may be cited as The National Health Service (Dental Charges) Amendment (Wales) Regulations 2000 and shall come into force on the 1st April 2000.

(2) These Regulations shall apply to Wales only.

Amendment of The National Health Service (Dental Charges) Regulations 1989

2.  In regulation 4 of The National Health Service (Dental Charges) Regulations 1989(2) (calculation of charges), in paragraph (5), for “£348” in both places where it occurs there shall be substituted “£354”.

Revocation

3.  The National Health Service (Dental Charges) Amendment Regulations 1999(3) are hereby revoked.

Transitional Provisions

4.  Where, on or after 1st April 2000, appliances are supplied, or other general dental services are provided, in pursuance of a contract or arrangement for the provision of general dental services made before that date, regulation 4(5) of The National Health Service (Dental Charges) Regulations 1989 shall have effect in respect of that supply or other provision as if these Regulations had not come into force.

Explanatory Note

(This note does not form part of the Regulations.)

These Regulations further amend the National Health Service (Dental Charges) Regulations 1989 to increase from £348 to £354 the maximum charge payable by the patient for dental treatment or appliances, where the contract or arrangement leading to the provision of such treatment or appliances is made on or after 1st April 2000.

1977 c. 49; see s.128(1) as amended by the National Health Service and Community Care Act 1990 (c. 19), s.26(2)(g) and (i), for the definitions of “prescribed” and “regulations”. Section 79A was inserted by the Health and Medicines Act 1988 (c. 49), s.11(3). The functions of the Secretary of State under section 79A, and paragraph 3(2) and 3(3) of Schedule 12 to The National Health Service Act 1977 were transferred to the National Assembly for Wales by The National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).
