Apelau yn erbyn gwahardd disgyblion yn barhaol

8.—(1) Rhaid i awdurdod addysg lleol wneud trefniadau i alluogi'r person perthnasol i apelio yn erbyn unrhyw benderfyniad gan yr athro neu'r athrawes â gofal o dan adran 52(2) i wahardd disgybl yn barhaol o uned cyfeirio disgyblion a gynhelir gan yr awdurdod.

(2) Mae'r Atodlen i Reoliadau 2003 yn effeithiol, gyda'r addasiadau a ragnodir yn yr Atodlen i'r Rheoliadau hyn, mewn perthynas â gwneud a gwrando ar apelau yn unol â'r trefniadau a wnaed o dan baragraff (1); ac ym mharagraffau (3) i (5) ystyr “panel apêl” yw panel apêl a ffurfiwyd yn unol â pharagraff 2 o'r Atodlen i Reoliadau 2003 fel y'u haddaswyd.

(3)  Nid yw panel apêl i benderfynu bod disgybl i'w dderbyn yn ôl ddim ond oherwydd i unrhyw berson fethu cydymffurfio ag unrhyw ofynion gweithdrefnol a osodwyd gan neu o dan y Rheoliadau hyn mewn perthynas â'r penderfyniad o dan adran 52(2) o Ddeddf 2002 y mae'r apêl yn cael ei dwyn yn ei herbyn.

(4)  Bydd penderfyniad panel apelau ar apêl yn unol â threfniadau a wnaed o dan baragraff (1) yn rhwymol ar y person perthnasol, yr athro neu'r athrawes â gofal a'r awdurdod addysg lleol.

(5) Ar apêl o'r fath caiff y panel apêl —

(a)cadarnhau'r gwaharddiad;

(b)cyfarwyddo bod y disgybl i gael ei dderbyn yn ôl (naill ai ar unwaith neu erbyn dyddiad a bennir yn y cyfarwyddyd), neu

(c)penderfynu oherwydd amgylchiadau eithriadol neu am resymau eraill nad yw'n ymarferol i roi cyfarwyddyd yn ei gwneud yn ofynnol i'w dderbyn yn ôl, ond y byddai fel arall wedi bod yn briodol i roi cyfarwyddyd o'r fath.
