Gofynion iechyd: planhigion tarddiol ardystiedig a deunyddiau ardystiedig
22.—(1) Rhaid i blanhigyn tarddiol ardystiedig neu ddeunyddiau ardystiedig fod yn rhydd rhag y plâu a restrir yn Rhan A o Atodiad I ac yn Atodiad II i Gyfarwyddeb 2014/98/EU, o ran y genws neu’r rhywogaeth o dan sylw.
(2) Ni chaiff y ganran o blanhigion tarddiol ardystiedig neu ddeunyddiau ardystiedig a heintiwyd gan y plâu a restrir yn y tabl yn Rhan B o Atodiad I i Gyfarwyddeb 2014/98/EU fod yn uwch na’r lefelau goddefiant a nodir yng ngholofn berthnasol y tabl hwnnw.
(3) Ond nid yw is-baragraffau (1) a (2) yn gymwys i blanhigion tarddiol ardystiedig neu ddeunyddiau ardystiedig yn ystod rhewgadw.
(4) Mae arolygydd a, phan fo’n briodol, cyflenwr, yn cadarnhau cydymffurfedd ag is-baragraffau (1) a (2) drwy arolygiad gweledol o’r cyfleusterau, y meysydd a, phan fo’n briodol, y lotiau ac, mewn achosion pan fo amheuaeth ynghylch presenoldeb y plâu hynny, drwy waith samplu a phrofi.
(5) Rhaid cynnal arolygiadau gweledol a gwaith samplu a phrofi yn unol ag Atodiad IV i Gyfarwyddeb 2014/98/EU, o ran y genws neu’r rhywogaeth o dan sylw ac, yn achos gwaith samplu a phrofi, yn unol â’r protocol priodol hefyd.
